Wang itu hanya dikembalikan selepas empat hari, dan dalam tempoh tersebut beliau mendakwa mengalami kerugian peluang dagangan serta layanan kasar daripada kakitangan. Pengadu kemudian menuntut pampasan, menaikkan tuntutannya daripada RM4,500 kepada lebih RM62,000, termasuk keuntungan yang didakwa hilang dan masa yang terbuang.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><strong>PENDIRIAN INSTITUSI KEWANGAN<\/strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Institusi Kewangan mengakui gangguan teknikal tersebut berpunca daripada masalah \u201ccore switch\u201d, dan menjelaskan bahawa kelewatan itu diperlukan untuk mengesahkan status dana \u201cinflight\u201d (dalam proses pemindahan). Mereka menafikan dakwaan salah laku kakitangan dan menawarkan RM0.85 (faedah empat hari) serta pengecualian yuran broker sekali sahaja sebagai tanda ihsan. Tawaran ini ditolak oleh Pengadu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>DAPATAN UTAMA ADJUDIKASI<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adjudikator mendapati Institusi Kewangan cuai atas kelewatan empat hari tersebut akibat gangguan sistem, dan menilai tawaran RM0.85 sebagai \u201ctidak adil dan tidak munasabah,\u201d malah \u201ctidak wajar.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Namun begitu, tuntutan Pengadu terhadap keuntungan yang didakwa hilang serta masa yang digunakan telah ditolak, kerana beliau tidak mengemukakan bukti mengenai dagangan yang dirancang dan tidak mengambil tindakan setelah dana dipulangkan. Tuntutannya dilihat sebagai cubaan untuk memperoleh keuntungan yang tidak wajar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>KEPUTUSAN ADJUDIKASI<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adjudikator menggunakan budi bicara dan menerapkan formula 1% daripada jumlah terlibat bagi setiap hari kelewatan. Oleh itu, Institusi Kewangan diarahkan membayar RM1,176.00 sebagai pampasan yang adil dan munasabah.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adjudikator turut menegaskan bahawa institusi tersebut tidak mempunyai dasar yang sesuai untuk menangani kegagalan sistem dan kekecewaan pelanggan, dan menyarankan penambahbaikan dalam pengurusan kejadian sebegini.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>The Claimant attempted to transfer RM29,400 from her savings to her trading account, but the funds did not appear due to a system timeout.
