{"id":9934,"date":"2026-04-28T11:12:01","date_gmt":"2026-04-28T03:12:01","guid":{"rendered":"https:\/\/www.fmos.org.my\/?p=9934"},"modified":"2026-04-29T15:25:28","modified_gmt":"2026-04-29T07:25:28","slug":"housing-loan-dispute-on-loss-of-interest-offset-benefit","status":"publish","type":"post","link":"https:\/\/www.fmos.org.my\/bm\/housing-loan-dispute-on-loss-of-interest-offset-benefit\/","title":{"rendered":"Pinjaman Perumahan - Pertikaian Mengenai Kehilangan Manfaat Tolakan Faedah"},"content":{"rendered":"<p><\/p>\n\n\n\n<p>Sam memperoleh pinjaman perumahan sebanyak RM720,000 pada 8 Oktober 2012 di bawah pakej XYZ Bank MortgagePlus, berharga BLR \u2013 2.40% dengan ansuran bulanan sebanyak RM4,589 untuk tempoh 19 tahun. Produk ini menghubungkan satu akaun semasa tanpa faedah yang ditetapkan kepada pinjaman tersebut bagi menyediakan manfaat tolakan faedah (interest offset).<\/p>\n\n\n\n<p>Pinjaman tersebut telah dikeluarkan sepenuhnya pada 11 Januari 2013, dan ansuran pada mulanya didebitkan daripada akaun semasa yang ditetapkan itu. Pada 31 Disember 2013, Sam meminta supaya akaun tersebut ditutup, selepas itu ansuran didebitkan daripada akaun semasa peribadi yang lain. Penutupan akaun yang ditetapkan itu menyebabkan ciri tolakan faedah tidak lagi berfungsi.<\/p>\n\n\n\n<p>Pada Jun 2024, Sam menuntut pampasan dengan mendakwa bahawa pihak bank tidak memberikan penjelasan yang sewajarnya mengenai kesan penutupan akaun tersebut. XYZ Bank menolak liabiliti tetapi memulangkan RM1,250 bagi yuran penyelenggaraan.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>PENEMUAN<\/strong><\/h5>\n\n\n\n<p>Pinjaman tersebut dijual secara bersemuka, namun tidak dapat dipastikan sama ada kakitangan cawangan telah menerangkan dengan secukupnya syarat-syarat MortgagePlus, termasuk keperluan untuk mengekalkan akaun berkaitan yang ditetapkan bagi menikmati manfaat tolakan faedah.<\/p>\n\n\n\n<p>Surat tawaran (LOO) dengan jelas mewajibkan peminjam membuka dan mengekalkan akaun semasa yang ditetapkan untuk menikmati manfaat toalakan faedah.<\/p>\n\n\n\n<p>Penutupan akaun pada 31 Disember 2013 telah menghapuskan mekanisme tolakan faedah tersebut. Kakitangan XYZ Bank yang memproses permintaan penutupan itu sepatutnya menyemak status pinjaman dan memaklumkan Sam tentang akibatnya.<\/p>\n\n\n\n<p>Sam juga tidak menyemak penyata pinjaman berkala. Penyata dari tahun 2013 sehingga 2014 secara konsisten menunjukkan faedah didebitkan tanpa sebarang pengurangan, menandakan bahawa manfaat tolakan faedah tidak lagi diterima. Semakan yang munasabah sepatutnya memberi amaran lebih awal kepadanya.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>KEPUTUSAN<\/strong><\/h5>\n\n\n\n<p>Berdasarkan prinsip keadilan dan kemunsabahan, pengurus kes mengesyorkan bahawa perbezaan faedah sebanyak RM163,714.63 dikongsi sama rata antara kedua-dua pihak.<\/p>\n\n\n\n<p>XYZ Bank memulangkan RM81,857.32 kepada Sam, sebagai penilaian seimbang terhadap tanggungjawab kedua-dua pihak yang mengambil kira kegagalan bank dalam memberi nasihat sewajarnya serta kegagalan Sam menyemak penyata pinjamannya.
