Beliau mengemukakan tuntutan kerosakan sendiri kepada pengendali takaful bagi kos membaiki enjin kenderaannya.<\/p>\n\n<p class=\"wp-block-paragraph translation-block\">Walau bagaimanapun, pengendali takaful menolak tuntutan tersebut kerana kerosakan enjin berpunca daripada tindakan pengguna yang sengaja memandu melalui kawasan banjir serta kegagalannya mengambil langkah wajar untuk mencegah kerosakan tambahan, sekali gus melanggar <strong>Seksyen D \u2013 Syarat 7 dan Seksyen E \u2013 Syarat 7(c)<\/strong> dalam terma dan syarat polisi.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>PENEMUAN<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Pegendali operator merujuk kepada terma dan syarat seperti berikut:<\/p>\n\n<p class=\"wp-block-paragraph\"><em>Seksyen D: Pengecualian Am - ini diguna pakai bagi keseluruhan Perakuan<\/em><\/p>\n\n<ol class=\"wp-block-list\" start=\"7\">\n<li><em>Gagal mengambil Langkah-langkah Pencegahan<br \/>Sebarang tambahan tidak akan dibayar jika selepas suatu kejadian atau kerosakan, Anda:<br \/>a. membiarkan Kereta Anda tidak dijaga atau <strong>gagal mengambil langkah wajar untuk mencegah kerugian atau kerosakan tambahan<\/strong>; atau<br \/>b. <strong>terus memandu Kereta Anda dalam keadaan tidak wajar digunakan<\/strong> sebelum melakukan sebarang pembaikan.<\/em><\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Seksyen E: Syarat - ini diguna pakai bagi keseluruhan Perakuan<\/p>\n\n<ol class=\"wp-block-list\" start=\"7\">\n<li class=\"translation-block\"><em>Hal-hal Lain<br>Kami hanya akan bertanggunggjawab menanggung rugi Anda di bawah Perakuan ini jika Anda:\nMengambil langkah yang munasabah untuk mengelak daripada sebarang keadaan yang boleh mengakibatkan berlakunya tuntutan.<strong>Perakuan ini tidak akan melindungi Anda jika Anda atau Pemandu Dibenarkan memandu secara melulu, iaitu, di mana Anda tahu adanya bahaya tetapi dengan sengaja tidak mengambil langkah-langkah mencegahnya. <\/strong>Ini termasuk dan tidak terhad kepada membiarkan Kereta Anda tanpa pengawasan semasa tidak dikunci atau dengan kuncinya berada di dalam atau di atas Kereta Anda.<\/em><\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Pelaras kerugian melaporkan bahawa Chris sedang memandu menuju ke Shah Alam ketika hujan lebat dan trafik sesak apabila beliau melihat kawasan banjir kira-kira 50 meter di hadapan. Walaupun tidak pasti tentang kedalaman air, beliau tetap memasuki kawasan tersebut sehingga air naik melepasi bonet hadapan, menyebabkan enjin mati dan amaran drivetrain dipaparkan.<\/p>\n\n<p class=\"wp-block-paragraph\">Beliau cuba untuk menghidupkan semula enjin dan sempat bergerak sedikit sebelum enjinnya mati sekali lagi. Selepas berjaya menghidupkan semula kenderaan secara paksa, beliau terus memandu kira-kira dua kilometer ke rumah walaupun enjin tersentak-sentak dan prestasi kenderaan berkurangan, sebelum akhirnya meletakkan kenderaan di ruang bawah tanah kediamannya.<\/p>\n\n<p class=\"wp-block-paragraph\">Penemuan menunjukkan bahawa kerosakan enjin berpunca secara langsung daripada tindakan memandu kenderaan ke dalam air banjir dan terus menggunakannya walaupun terdapat tanda-tanda jelas kerosakan enjin. Langkah yang munasabah tidak di ambil untuk mencegah situasi tersebut dan keputusan untuk terus memandu walaupun terdapat lampu amaran serta enjin tersentak-sentak menunjukkan kegagalan mengambil langkah berhati-hati yang sewajarnya.<\/p>\n\n<p class=\"wp-block-paragraph\">Walaupun pengguna mungkin tidak memahami sepenuhnya tentang risiko yang terlibat, beliau sedar tentang banjir di hadapan. Namun, beliau meneruskan perjalanan tanpa menilai kedalaman air, yang tidak memenuhi tahap langkah pencegahan munasabah yang dijangka daripada seorang pemandu.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>KEPUTUSAN<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Ombudsman mengekalkan keputusan pengendali takaful kerana Pengecualian Am dan Syarat polisi mewajibkan pemandu yang dibenarkan mengambil langkah pencegahan yang munasabah serta mengelakkan penggunaan kenderaan dalam keadaan tidak selamat atau dengan cara yang berkemungkinan menyebabkan kerugian.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>Chris\u2019s vehicle engine damaged after driving through a flooded stretch near Shah Alam.
