Motor Own Damage – No Impact Damage

Carol experienced an incident when an unidentified lorry splashed liquid on her car, leading to corrosion, cracked paint, and staining. Unfortunately, the insurer denied Carol’s claim, stating that the event did not fall under Section A(1a) of the policy.

OUR FINDINGS

Section A(1a) details coverage for events under Comprehensive insurance, including accidental collisions, mechanical breakdowns, wear and tear, impact damage from falling objects, fire, theft, and transit related incidents.

The insurer stated that these provisions didn’t cover the splashing incident.

The loss adjusters confirmed damage to various parts of the car, including staining and corrosion. However, there was no collision damage. Despite Carol’s claim of not receiving essential documents before or after purchasing the policy, a review showed that the incident did not align with the policy’s terms and conditions.

OUTCOME

Upon comprehensive review of the policy contract, it was determined that the specific circumstances of this incident did not align with any of the perils listed in the policy. Furthermore, no other sections of the policy were found to be relevant to the claim.

Our Case Manager made a recommendation in favour of the insurer, as their decision is in accordance with the terms and conditions outlined in the motor policy.
